Will Apple replace my iPhone 3G

I'm out of warranty and i got this refurb on the last day of my warranty recently it has been changing songs randomly (not shuffle), it stops songs sometimes or will will go to the next song a couple seconds in. It happens completely random but i'm not sure if apple will replace it

i've tried that, the problem is i don't want to have to pay a fee i just want a simple swap

restore via itunes.

Also, try downloading a free app (or an app you've already purchased; if it's already on the phone delete it first - or try updating) onto the phone. The behavior almost sounds like it's skipping protected songs - the app "purchase" should reauthorise your phone.

Shake to Shuffle is off...

I've already restored and set-up as new

also i frequently download apps from App store should that shouldn't be a problem
