Caved and went back to the Apple store. This time they were sold out of brand new phones so I had to take one of the genius bar replacements (still brand new of course considering the phone just launched).

First one he brings out...ANOTHER scuff on the side. That basically means my first three iPhone 5's had cosmetic damage out of the box.

He brings out another, which appears flawless. I honestly just gave it a quick glance and I'm gonna throw a very thin case on it. I don't even want to know anymore.

If I knew they'd let me swap for white, I'd drive 90 mi to the closest Apple store.
Just tell them you want to return your phone for a refund if they won't let you "swap."

Then you can just buy the white outright. I've hard you have to wait a few days for your upgrade eligibility to re-post.

Just give the Apple store a call and ask for a manager. Talk it over and see what they can do.

Damaged out of the box with numerous bezel nicks and some small scratches.

I've spoken to, and received several emails from an Apple Senior Specialist who is shipping a return box which I should have tomorrow. I've been assured that I will have a new phone within a week, possibly sooner. I couldn't be happier with the courtesy and professionalism that has been shown to me so far. :)

I think everyone who comes here and post anything like. " every device will tear and wear after time" "little scratch or scuff doesn't bother me" they must be working for apple. You buy a brand spanking new phone for $700 it's a big investment to most of us, then you should receive brand spanking flawless phone.

I am going to try for this same result when I go to my appointment tomorrow. Did you say anything in particular to get the genius to agree to placing this type of note on your serial, or was it pretty freely offered because of the lack of guarantee in getting a better unit at this time?

Sorry for such a late reply, I've been out all day. Not really. I spoke with the Genius about how frustrating it was to have damage on an expensive phone right out of the box, and he said he'd "take my word for it" and believe it was damaged, but they had a super limited stock and no unopened ones to replace it with. He didn't want to give me one of the open models that they keep for malfunctioning phones because they only had like 10 in the store and wanted to save them for serious matters.

He said he was going to make note on my serial model that I spoke with him and that I need to get my phone replaced free of charge. He just said he was going to give me 60 days since there's a chance that it'll be difficult to get a hold of a perfect replacement in the next 30 days just because stock is so limited. He also told me I might get a little trouble if I try returning it after 30 days (because that's past their return policy) but he said that by writing it in my notes that I'm guaranteed to get it. Obviously I'm going to try to get it replaced before 30 days, mostly because I want to avoid any trouble haha.

i doubt it considering i watched a video where a guy took keys to it and then when he was done wiped the marks right off.

I watched another video where the woman with her baby took a ring and scratched the hell out of it.

Limited Edition unique 1st batch phones?

32GB Black/Slate
Week 36, Factory F2

Out of the box with 2 bezel nicks on the lower right (top side). scratches were hard to see but if looked very close, the edge between the back plate and the side showed a few uneven tiny leakage (pin width) of bare metal. Not sure if a replacement will be 'flawless' so I am thinking of keeping this as a 'limited edition' 1st batch unit.

Anyone waiting for the October releases for this to be fixed is fooling themselves. Apple is not going to change anything in the production process until maybe the iPhone 5s. If you want the iPhone 5, might as well get it / keep it now and keep returning it until you get a flawless one and throw it in a case.
You actually believe that? They are losing money on these returns. I'm sure someone will be looking into the issue.

They are all functional. But, no, they are not merely TOOLs.

Under normal usage, my Watch doesn't scratch. My computer doesn't scratch. My car also doesn't scratch (unless by accident).

NOR should a cell phone scratch. My iPhone 4S is 100% like new, as it should be.

Just because YOU treat your devices like a TOOL, doesn't mean jack.

A car and a laptop are not products meant to be crammed in a pocket or consistently brushed against other objects.

You must have a really cheap rubber watch because my $9,000 Rolex definitely has scuffs on the stainless steel bracelet.

Your expectations are foolish. Buy another cellphone. Stop whining about nothing.

I bought Incipio feather Cases on my last four androids and waiting for Best Buy or Rogers to stock up. I like Incipio's feather series because it's light & thin and also includes a screen protector.

My $50,000 BMW has a $1,200 windshield that after 1 month of driving has tiny chips and scratches. It's a windshield, it rubs up against the elements, it's expected to function perfectly but have minor cosmetic wear. Just like a cellphone.

Well we might disagree whether it's okay to have dent and scuffs on a brand new frickin phone, but I see your post go down into so personal here.

Who are you really to tell people to stop whining about their own purchase? Did you buy those people their iPhones? Was it your money? Or was it their own hard-earned money buying a premium phone which happened to be not so premium after all?

I don't care if you throw your $9K wristwatch down the river daily. You don't buy things for those people, so you don't tell them what they're supposed to do.

Everyone has rights to had a buyer remorse when it's right to do so. It's a free country anyway.

Oh wow! that's pretty bad! I was going to swap my white for a black via Apple tomorrow but I don't know if I will now.

I got hypnotized by the black one today and it was screaming "Buy me, buy me"

Yep. The hole around the lens is just crazy. I am still fighting with apple that is acting like they won't exchange it for a white. 7 calls to apple corporate, 2 trips to the store to be turned down. Now they say they have my name down and will hold me a white one. Who knows if that is true.

This thing is durable as hell under normal conditions. Obviously if you take a knife to it, its gonna show.

I've been scraping mine off wooden floors, desks, and even my bedroom wall. Not a single mark (other than the ones Apple happily included out of the box).

thinking logically, i would guess design flaw??

with the pots + pans thought now, i can't believe that it could be a bad batch of the chemical process, this black iphone 5 is toast....

bar none, get the white iphone.......

SPOILER ALERT: All phones scuff and scratch.

So whining about a scuff the size of a piece of dandruff that was going to happen next week anyway isn't a good use of time today. If you go to the hardware store and get a shiny new key cut its going to look all scuffed after the very first time it's inserted into the cylinder and turned. So if the key maker accidentally puts a teeny-tiny scuff into it before you take it home it's of no consequence.

Get it?

You're screaming at Apple because you want a scuffless iPhone out of the box yet the moment you lay it on a counter or put it in your pocket it's going to scuff. You just want the right to scuff it first.
