Is that normal for a new iphone 5s out of the package it was 16gb and I know some is the is but that much?

Yep. iOS 7 takes up about 3.1 gb for the OS. You having 12.9gb available on a clean phone means the math checks out 🙂
On a 16GB device, only 14.9GB will be usable. iOS takes about 2GB of that, leaving you with about 13GB remaining.
