Only way to bypass this is to put it in DFU mode and then recover since you do not have a computer that the device last synced with. If you did have the computer then it would be easy and you could simply restore from iTunes. Anyways doing so will restore your iphone/ipod but you will lose all the information stored on the device, and since you mentioned you never updated I would suspect you don't have a backup of the device so basically you would need to re-download all your apps from the app store again. Take this as a lesson and make sure you sync your ios devices with your computer next time. Anyways just do a google search or search through the forum for how to put device in DFU mode.

Perhaps he bought an "iPhone" on craigslist but was given a stolen iPod Touch and he couldn't tell the difference because it was locked ... (not that you shouldn't be able to tell the difference anyways)
