"3rd times a charm" repair policy?

    I have a 13 inch late '09 Macbook, that has failed for the 3rd time on me today. Apple is going to fix it, but they acted like I shouldn't deserve a new Macbook. I would like to note that during the 1st repair, they actually damaged the casing that surrounds the ethernet port. The 2nd repair consisted of them basically fixing their mistake. The ethernet port casing was bulging, which, in time, caused the rubber pad under the mac to bubble. They replaced the rubber bottom, and fixed the bulge, but left the damaged casing.

    I do not have 'special' apple care, I am just going by the 1 year warranty, and this is ridiculous. I just want to know if there is some sort of policy that Apple follows, that on the 3rd ******* up, they give you a brand new mac.

    Any feedback is GREATLY appreciated.
