You won't get a new boxed phone...they will give you a (most likely) new, unused phone from a supply of phones that do not come with all the accessories, etc.

They will instruct you to keep your box and accessories and just trade the actual device. Let us know if your swap ends up with you getting a non-annoying, non-buzzing phone.

Well... after some convincing I got them to swap the phone, however this one buzzes as well. oh well i tried.

The guy said his sounds the same and there is nothing wrong with it and that he couldn't swap it for no reason, but he talked to his manager who approved a swap. He said there was no guarantee the new one would be any better and I couldn't swap it again for that reason. I knew as soon as he handed it to me it had the same problem, I could hear it in the NOISY apple store. i guess its not THAT big a deal but after first hand experience of how beautifully silent it can be, its just hard to accept :(

perhaps i'll just walk around with a clamp on the lower right corner

I don't know technically how these things work, but can apple adjust the vibration at all? like if they could turn it down a little, maybe it wouldn't hit the "sweet spot" frequency that makes the phone buzz. if that's even the case.

Just a follow up from me. I called Apple monday to make sure they're willing to swap, and they were, so I went to Three, and told them about the problem, and that I talked to Apple. They took it in straight away, and it seems like a swap unit is on it's way to me. I hope this new phone won't buzz like the former.

I had a genius bar appointment since I was going to mall yesterday anyway.
The genius listened and heard the issue. He took it outback to take a look inside and said it looked good inside. His colleagues said theirs had it too.

He then told it looks consistent across all new 4S. He offered to do a swap but said I would lose my full 1 year warranty. It would be replaced by a 3 month warranty. Is this true???????

nope. you still keep your 1 year warranty. they told me i would lose the ability to return the phone to at&t (i was still within my 30 days) but i would still have my normal warranty if something else should go wrong.

while my replacement is not silent like some of the others i have seen, after using it at work yesterday, it is definitely a little better than the first one i had that alerted the entire office every time i got a new email

I'm not sure when this can be called a "wide spread" issue, but does anyone think Apple will officially acknowledge this at some point?
