There is nothing illegal about that. They queued and paid for the iPad, legally. And then you buy it from them, assuming mutual consent, no violence involved, and payment is made, I don't see anything illegal. They can be annoying and you can hate them for buying up all the iPads, but that's completely legal.

They can be annoying and you can hate them for buying up all the iPads, but that's completely legal.
If you go that route be prepared to pay way, up to twice the retail sale price.
