I suspect because eBay hasn't gotten to all of them. It could just be a matter of some of them operating until eBay shuts them down. Or, eBay decided that they can't determine if a buyer is a new or old purchaser.

All I know is what the Librarian of Congress said. Unless that's changed, this is now a grey area.

My question is a bit out of topic but I'm just really curious. 2 years ago I was trying to sell an activation code for a software on eBay as I got 2 from buy-one-get-one-free promotion. Anyway, my item was soon deleted by eBay and I was informed virtual items were not permitted.

Anyone knows how those att iphone unlocking people sneaked through ebay's surveillance?
