(Taxes excluded) the only way to make money on this deal is if he DIDNT WANT the phone and was staying on contract anyway so didn't care if he used his subsidy.

The OP would re-coup the original $399 he spent on the phone by selling his phone on Craigslist for $1200. That's where the $777 comes I'm at. So he's SAVING money by doing it this way. Actually he's saving over $300...

OP if I were you I'd do it on you are going to only have an out of pocket cost of around $125 compared to $425. You may have to wait a little longer to get the phone, but still... You're going to be getting an unlocked iphone 6 for way less than $200
I know it isn't directed to me and I get what you are saying but offering someone 1200 for a phone, which you already paid $400+taxes for and will have to pay $850+ taxes for another phone isn't that great of a deal. Sure you will have a net gain in the end (if the person is legit) but it is risky and not worth it.

not over $300 because of taxes (he would have to pay taxes on the $400 and the $1200 unless he lives in a tax free state)
If you are a poor college student, then I would do it. If not, just keep it. You have to ask yourself if it's worth $300 to wait another month or so for the phone. Side note: don't tell your gf or wife or else they will tell you to sell.
The benefit is $350 minus the sales tax on $850. (Since he has to pay the tax on the first $400 phone regardless of whether he keeps or sells it.)
Also, OP, my gut tells me you can get more than $1200 for my phone at launch. Supplies are ridiculously limited. That's home much I sold a Gold 5S for, and I could have gotten more based on the subsequent texts I got while driving home from the mall post sale.

Worst case is the OP PAYS $400 plus tax for the phone so say $440 then he sales it for $1200 and makes $760 of that plus his original $440
