after reading some other users experiences i think this loop hole is real and will work.

i'd almost feel bad if at&t wasn't such a pain. i'm part of a small family business (been in the family for 60 years, 6 employees, 4 phone lines, net service and minimal at that, along with the cheap yellowpages add) and my monthly bill as is right around 900$ a month. we've used at&t for ages. I know we've had a mobile with at&t since 1995. still because of the way the rules are written and we "upgraded" plans and got nokia 2610's when we did i'm not able to get an iphone for 199/299. not exactly taking care of your customers i wouldn't say. i've given them a lot of money.

so i WILL go for the subsidised price and if it doesn't work i'll stick with one of these cheap iphones that will pop up next week! sure it's not 3g and no gps but aside from that it's basically the same thing.
 
Yes it will work. Just activate a v1 iPhone with an acceptable data package BEFORE July 11th and your eligibility will change to eligible. I did this. I had a BB Pearl and I have an iPhone v1 that I purchased launch last year, I went back to my BB Pearl and removed my iPhone package. I just reactivated my iPhone yesterday and added an iPhone data package and removed the BB package and it now says Im eligible for the $199/$299 pricing. As long as you walk into the store on Friday, you give them your account number or mobile number, and if they see that you have an ACTIVE v1 iPhone as your primary phone, you're upgrade eligible at the subsidy. I did this. Also, call ATT and get it in writing. They'll add it to your account notes in case of any question. Hope this helps.
 
did it work?

On the 9th I borrowed a friends iPhone at work, swapped sim cards, activated it over iTunes there. I went from being not eligible to instantly eligible. I immediatly gave the iphone back, so she continued to use it with her sim. I left my my out of my old phone, just in case.

On the 11th, first 10 in line, got the 16gig for $299, no questions asked, never asked where my iPhone was or if I was an existing iPhone owner, or even my existing sim card, just noted I'm eligible for the lower price. (they may have had me do the sim card at home because of iTunes crashing, who knows)
