Your question is obviously complicated. We dont know for sure what ATT will tell you, your best bet is to talk to them. My gut is that in order for you to get an iPhone compliant SIM you need an iPhone plan, and they might still try to nail you on the 2 years. But talk to them and maybe you'll work something out. None of us in this thread work for ATT (AFAIK) so we can't guarantee what they'll do or any relative merits and cons of the requirements they place on the plans.
let us know what happens!

Wow, the ignorance in this thread.
Some people dont get it or dont want to get it.
No, it will not work. You need to sign a 2 year contract to use the iphone even if you have a previous AT&T account. As soon as you transfer your phone number to the iphone the2 years start.
Call up AT&T and ask them yourself.

But it was deactivated, meaning he must ACTIVATE IT THROUGH ITUNES JUST LIKE EVERY OTHER IPHONE ON THE MARKET.

You could not be more wrong about this point. The phone does not get deactivated . If it did you would not be able to use it as and ipod / wi fi web device. They are selling iphones on ebay that DO NOT need to be ativated on itunes to use go check it out yourself. As far as the contract with AT&T like it said you might will have to sign a new 2 year contract. The best thing to do is call AT&T and ask.

Once you go thru itunes and try to enable your phone to be used with your existing AT&T number or opening a new account you're automaticly signed a 2 year agreement with AT&T.
theres no other option.
How hard is it to understand that once you start phone service with AT&T and enableing an Iphone to be used on their network thru Itunes its a done deal.

I understand what your saying but this new customer does not have to activate the phone through itunes. The phone has already been activated. When you plug it into itunes it wont ask you to activate it. Are you saying that the new owner will have to activate the phone through itunes again? From what I understand you dont have to. itunes would see the phone as already being activated and you could then sync your songs or video or whatever. To get the phone part of the service re established with the new user you have to go to at&t and they will probably make you sign a new 2 year agreement.

type in command prompt this!!

“C:\Program Files\iTunes\iTunes.exe” /setPrefInt StoreActivationMode 0 and you will be fine tell me if you need more help!!

Three things. This thread is over a year old. Is the info you provided for iPhone or iPhone 3G AND is this for a PC or Mac? Can this unbrick my iPhone Original when I update the software.
