Hold the power button and home for 25 seconds.

    you can restore your ipod.
    turn ipod on,
hold the home and sleep button until it turns off and turns on again. when it turns on and the apple logo appears, release the sleep button while still holding the home button. it will probably tell you to connect to itunes. so connect to itunes and it should force a restore.

To add to the above post, I believe you must be connected to iTunes while restarting and holding the home button.

no, it shouldnt as long as you restore it before you send it back.

Jailbreaking does nothing to the actual hardware or firmware, only the operating system on the iPod, which can be recovered at any point in time. I'd have to say it's pretty much undetectable.
