Why do you say that? I've seen videos that seem to show otherwise. Apple's own explanation is "If app controls or menu bar items appear blocked or hidden behind the camera housing, you can turn on "Scale to fit below built-in camera" for the app to adjust the active area of your display."

Check your videos again. The file menus respect the notch. Only dock icons on the right, if they are very wide, might end up under the notch!
I am writing this on a 16"notchbook so I think I have a reasonable idea!
 
Pity there is no option of this MBP without this annoying camera (and notch). I myself never ever use some "camera" etc. and maybe I am not alone. Quite useless thing for many users it may be.
 
Please explain more what you're seeing. This is what I've seen in more than one place.

What I am seeing is that iStat menus is under the menu bar. And iStat menus is NOT a menu from the current open app but a menu bar widget living un the righthand tray of menu widgets.
I am not saying this is right, but app menus are respecting the notch. Different thing altogether.

Use an app called top-notch but what I do is just put a dark background on and turn on dark mode.

I can't tell what you mean by "under the menu bar." The video above shows that menu items are invisible because of the notch.

My understanding is that some apps do mind the gap, as it were, and those must be what you're looking at. But Apple says and I've seen some do not. That's why Apple has included the "Scale to fit" feature. If what you said always applied, it wouldn't be needed.

No it does NOT. I watched the video. It is iStat menus that is under the notch. And that is a widget, not a program menu. But hey, you seem to be unconvincable so just believe what you want. And perhaps look up Dunning Kruger effect on google!

You seem not to be reading most of what I say, so I'll leave you to believe what you prefer.
 
I am using an app to make the menu-bar black so the notch "disappears" (loved the black menu bar anyway in old MacOSes), but has anyone found a way how to make the menu-bar smaller, so that it goes in-line with the notch? I haven't understood why apple made it a few pixels wider (= taller)...
