Can't be patented. There is prior art. Someone posted it on MacRumors, where everyone can read it.
 
Plus it would have to work out when it is in your hand and not say resting on a table, or in your pocket.

Many people hold their phones in their hands while walking around. Also,how will you solve the problem that you just locked the phone while it is still in your hand?

A cooler way would be using the combination of the accelerometer, gyro, and ambient light sensor to determine if you are pulling the phone out of your pocket. You're welcome.
