Amazon did win in this case. Apple put forward a frivolous claim and withdrew it when it became clear they would not be successful. The article didn't state that everyone knows that the App Store is associated to Apple; the Apple spokesperson did.

Wrong.

Amazon wanted to call it appstore. Apple didn't want them to call it appstore.

Amazon gets to call it appstore.

What are you talking about? Evidently, more people is buying iOS or OS X apps in the Apple App Store than in the Amazon Android Appstore. But I bet you that more people is buying Android apps on the Amazon Android Appstore than in the Apple App Store.

By the way, since Apple lost the trademark and they have unilaterally drop the suit it is evident who has won the case

Don't say everyone, or you'll set my dad (and probably plenty others) off on a tirade about how CNR was the original "application store, what we used to call it". Then he'll say something about how shortening up the name doesn't make it yours.
 
You apparently have no idea how much money Apple has. Hint: they have LOTS and LOTS of money. If you think they have been holding back on R&D due to their legal budget, you're wrong.

You seem to be assuming too much. No one has said they are holding back due to a legal budget. Go back and read my posts.

Nothing personal Z but I get the feeling that if Apple ever came to a sudden stop your head would be dangerously close to resembling a suppository...
 
lol what i mean is, that they can invest more money into other projects instead of these type of lawsuits.

And what I mean is that with something like $110 BILLION in cash reserves, lawsuits are unlikely to have any effect whatsoever on other activities in the company. :D

Agreed, got to the point where Apple was the bigger man and walked away from the fight, knowing that any victory would have done more to tarnish them than they would have gained.

Term pyrrhic victory springs to mind.

They can now focus on the big battles without being labelled a spurious litigator - i.e. fighting the critical android suits and making great products, so this is good news all round.
 
I can't imagine explaining to my kids and wife / husband what I did for a living for this time period of my life.

As I said in all the previous threads on this matter - there's no customer confusion. You can't install iOS apps on Android devices and vice-versa. The very first time you "tried" - you would immediately know this was possible.

Confirmed by the spokesperson "customers know where they can purchase their favorite apps."

Also stated as a dig against Amazon/Android. But it's definitely a "win" (although who really cares) for Amazon.
 
its not as if ppl with iphones could get mistaken and download off the amazon app store and vice versa, pointless case to start off with, its a store for apps (aplications) its far too generic to own.

"Download this app from the App Store." Which one? Though Amazon's looks like it's called "Amazon appstore", which is quite different.
 
In this case it was very sensible given how stupid it was in the first place. There was no way in hell Apple would get the rights to take control of 'Appstore' as a term.

Why not? Think about hoovering. How many people go home and Electrolux the dining room? Hoover coined the phrase and everybody uses it to sell products of other brands.

Both of your messages say that Apple should be spending more on innovation instead of lawsuits. My point is that Apple has enough money to do double of both if they wanted to, so your point is nonsensical.

This analogy would make sense if Hoover called their product "vacuum" and then trade marked "vacuuming" but they did not (they would get just as far as Apple did with their stupid lawsuit).
