I abhor the idea of patent trolls and the patent suits we normally hear about (Qualcom and Apple, Apple and Samsung, etc) but I also hate the idea that major companies by coincidence or design are meeting with real innovators and stealing their ideas and possibly their hard work.

Yeh the biggest spenders get the best results in court. That's not a problem with patents per se but a huge problem with the legal system that needs to change. Anyone can file for a patent but it takes a huge amount of time and money to actually uphold it.

While I feel for your friend and other innovators, the patent system was originally setup to teach others how to do something a certain way in exchange for a period of exclusivity—while you can sell your own product without fear of someone else ripping you off and selling for lesser amount. Basically, patents award first to market. It's hard to hold onto an idea if you don't have a product to sell. And it's even harder to win damages in court if you only have an idea. Many people go for trade secrets over patents (eg coca-cola's formula or WD40). That's nearly impossible to do in tech.

This is why patent trolls are just that.

Samsung and Android pay use the exact same backend system (Samsung is slightly different for MST) for Visa cards. There is very little difference. This case will go nowhere.

Samsung/Android Pay have no bearing on this case. Regardless of what they use for a backend system. They could: 1. have licensed the patents already 2. Be next in line for a suit pending the resolution of this case 3. used tech not covered by these patents. 4. have nefariously and surreptitiously funded this campaign against Apple in a bid to undermine the success and spread of Apple Pay.o_O:p:D

There are no correlations that bring either Pay service into the conversation. This case will stand or fall on it's own merits. To say it will go nowhere is shortsighted considering the suing party.
