So I called 1800 my apple today and spoke with someone in the iphone tech department (the ipod touch does not fall under the ipod department). I explained what was going on with the negative black issues the tech had me do a restore/update through itunes. I told him that did not fix the problem he then sent me to a iphone specialist. The specialist told me that he has heard of this issue and is going to send me a brand new 16gb. I don't know if I should send mine back and get the new one since it could be the exact same or worse I would also go past my 15 day return policy. Has anyone else called in about this issue if so what responses have you got from the techs?
 
I called earlier in the day (around 1pm pt) and got sent to the iPhone department, too. The person on the phone listened to my story (hadn't heard of it before) and all she did was set up an appt with the local Apple Store genius bar--something I could have done on my own.

If I have any trouble returning/exchanging it at the local Apple Store, I'll call Apple Tech Support again.
 
when you get a replacement, your 14 day period gets reset to the day you get the new one. that's what happened to me when i had my iphone replaced. i did this in-store, though. i'm not sure how it would work online; you should ask.
