My wife dropped her iPhone 13 and chipped the aluminum side, she has Apple Care is that ok to open a claim for a replacement ?

Do you have Apple Care including accidental damage and loss? If so, Apple will repair or replace it less the deductible. If your Apple Care does not include the accidental damage and loss, then the repair cost is on you.

I have Apple Care with theft and Loss and includes that my concern if is more like cosmetic issue they will replace it anyway using the express replacement option

Regardless of what anyone says here, it can’t be taken as gospel. You’re going to have to ask Apple directly to get the real answer.

Yes you can request an express replacement or take it into the store and see if they can fix it

I thought scratches, chips and small dents were considered cosmetic damage and won't effect functionality so they do not qualify for replacement.
Found this on there terms and conditions page:
4. What is not Covered?
4.1 Hardware Services and ADH Services
Apple may restrict Hardware Service and ADH Services to the country where the Covered
Equipment was originally purchased.
Apple will not provide Hardware Services or ADH Services in the following
circumstances:
(a) to protect against normal wear and tear, or to repair cosmetic damage not affecting
the functionality of the Covered Equipment

I guess it doesn't hurt to ask Apple it's really up to them anyway..
