No Apple did not actually, it only really won in the US. And this is not defending yourself, this is purely playing the pathetic excuse for a patent system the US has for its own personal gain, again.

Apple is dong the exact same thing it always does, just sues it’s suppliers to get cheaper rates, which it never passes into the customer. The Ericsson case will go down as the perfect example of this.

We should replace the current system of national patents with an independent international body that grants and reviews patents worldwide.
There are already patent treaties, but no nation likes to give up sovereign control to international bodies.
 
Most patent cases are filed with the 5th circuit court.... I wonder if that's where they are trying this case....

That little town in Texas that lives off patent trolls? I hope not. I'd rather see it in California, where both of the companies are, and where juries understand patents and Silicon Valley.

Apple was even forced by the courts in the U.K. to print a public apology in the press for the way it behaved over its obsession with Samsung, which Apple took as a joke at first to which the courts did not and told Apple to do it again or find themselves in contempt of court or something to that effect:

That’s how peed off the worlds court got with them, but mainly Apple as it tried to ban Samsung from the planet, for no other reason then blocking the competition.
 
Challenging patent validity is one of Apple's typical strategies in its legal battles.
I would hope lots of companies do this. On the face of it patents get granted for some ridiculous things when they shouldn't have in the first place with the patent office leaving it up to the courts to determine if a patent is valid.
Perhaps they should assign the court costs of cancelled patents to the patent office. I'd bet that would make them do better work.

The patent system is so screwed up, it's insane.

Here's the pincher which I find quite funny. This is going to lose Qualcomm business - as Apple are not moving away from their chips. Classic case of don't bite the hand that feeds you.
 
I wonder how much money Apple spends on lawyers in all these legal battles.
Apple started the patent battle when they claimed Samsung copied the look of the 3GS. i say they deserve everything they get on patents as a result.

This is going to be a difficult battle. Qualcomm's entire business model revolves around patents, and they likely file loads of broad, opportunistic patents for downstream devices even though they don't make any of them. Apple makes those downstream devices, and also hold some patents for upstream technologies, but likely not enough to threaten Qualcomm's immediate sales. Upstream stuff (like data encoding patterns) tends to be fairly specific, and consumer-related stuff tends to be fairly broad.

So it's easier for Qualcomm to get an import ban on Apple devices than it is for Apple to get an import ban on Qualcomm's chips.

Firstly you do then admit that you were wrong? You said that it was only the US where Scamsung, sorry I mean Samdung..I mean Samsung were being sued.
They were sued in many many countries. So your point about Apple being turned down in some countries means nothing.
next Apple were not trying to ban the competition because there is NO competition. Apple makes over 90% of worldwide smartphone profits. This with Samsung selling phones in many countries.
Also it was proven, pROVEN that Samsung DID copy the iPhone in many ways.
Samsung's own lawyer got confused and mistook the iPhone for a Samsung phone!
PLus internal Samsung documents were shown that were entitled how best to copy the iPhone.

Does this make Apple innocent in all things? Nope of course not but please do not bring your Apple hatred to a topic where Samsung are clearly wrong and clearly guilty! (regarding your point). Plus in relation to Qualcomm we do not know the outcome of the case yet so we will see.
 
Suppose Apple is working on a new product feature, and they find that a relevant patents exist.

They could (a) pay for a license, (b) challenge the patent's validity, (c) ignore the patent, then pay for a license if the patent holder files for infringement, or (d) ignore the patent, then fight it in court if the patent holder files for infringement.

Which do they tend to do? What does it depend on?

We hear about these cases when they reach court, but I'm curious what happens before that.

They could always find a way to do the same thing but different enough NOT to fall foul of the patents. However most engineers are told NOT to read patents in case they are accused of wilful violation and therefore liable to triple damages.

I am not wrong, but the first sentence of your post tells me you’ll never believe any facts and that Apple is the Mesiah. So no point discussing anything with you, I didn’t read much of your post past the first sentence.
I find it pretty immature when people refer to Samsung in that way.
 
This is what happens when endless amounts of things that should never have been allowed to be patented, get filed away. They will settle, I wish they wouldn't though, more battles need to actually go to court so sort out some of these weak and frankly stupid patents.

Apple is so big and has so much money, they will force others to have to pay millions to protect it. It's cheaper for Apple, in the long run.
 
Ahhhh another episode of how the patent system is broken and needs reform when it works against Apple but how important it is for the protection of intellectual property when Apple is the one with a patent. Is there any other kind of thread topic where the bulk of us talk more like politicians than this one?

<any company not named Apple> is so wrong for seeking a patent fee/claim against Apple.
Apple deserves every penny when <any company not named Apple> infringes on Apple patents.

Patent troll when anyone else holds a patent that conflicts with anything Apple wants. But Apple patents are (the one and only) valid patents.
