This is the terms of service for the upgrade process.

section D : Wireless Service Activation. The Financed iPhone requires activation on a new or existing wireless service plan with an eligible carrier under the carrier’s terms, and may be subject to an additional fee charged by your carrier.

EDIT : The carrier phones DO come with a 36 dollar a line activation, and a contract even if you bring your own device. Apple makes money, they dont give things away for free. I can see this in the verizon TOS.

This means, you MUST sign with a carrier, or port a number, and / or already have service with said carrier. The CARRIER phones ARE LOCKED, and can ONLY be unlocked via THAT carrier. This is done for a reason.

An UNLOCKED phone allows you to move about carriers however you see fit, yes, it's more beneficial to US as the CONSUMER, but then apple does NOT get credit for an activation, and activations on carrier lines get apple a glorified affiliate payout, a kick back if you will.

So while i COMPLETELY understand what you're saying, and i agree that the wording is a bit " meh ", it still says what it says, ignorance of common sense is NOT an excuse to start spewing off about class action law suites. And since you're so big in feeling like you're getting screwed, please take note of THIS line as well :

Early Upgrade Option. At any time six (6) months after the date of enrollment, you can become upgrade eligible by making advance payments so that you have paid the equivalent of at least twelve (12) installment payments under your Installment Loan plus any taxes and fees paid at the time of enrollment.

This means if you purchase an upgrade plan in july of next year, and the new iphone comes out in september, YOUR NOT GETTING ONE unless you pay up that balance!!!!!!! I can't wait for these threads to start next year for those who don't have the plan for at least 12 months.... because it will happen, and i'll be just as informed for those guys too :)

I really hope you stand back, and look at your situation from an unbiased point of view. Carrier phones via apple are locked, they are not unlocked like MANY people have reported, this is also listed in the terms of service of APPLE , not just the upgrade plan terms of service. I'm sorry you don't think i can read, but as i've outlined above, it has nothing to do with reading, just a little research and you can easily tell what they are expressing. so to sum this up, you had an appointment setup to purchase a phone, the appointment card siad you were going to purchase X phone with X upgrade plan. The terms, and website say you must purchase upgrade plan phones in a store, and in fact, tell you to SPEAK with them to get more information. you took your appointment card, had your appointment, spoke with someone, like the site says to do. You were given " more information " like the site says, you were unhappy about said information, and now you think apple baited you.

does that about sum it up?

Oh the nefarious sales tactics of Apple... selling you their product, but not in the way you wanted them to sell it to you?
 
same thing happened to me...reserved 6S sim free, went to Apple and they told me no. Had to get ATT instead, long drive too.

This has been gone over several times. Activate the Sim-free phone then if required.
I'd like to clarify that sim-free devices cannot be activated during a point of sale transaction at Apple Retail.

Activation follows the same way it works at any carrier. Apple scans the UPC, serial #, IMEI and ICCID in order to have the sim card inside the new device be activated with your carrier account. This is all done when the Specialist is ringing you out, prior to payment.

Since sim-free devices do not come with a sim, they cannot be activated. You simply swap the sim from the old phone into the sim-free one. This is why they cannot process sim-free iPhone upgrade programs. I would be wary of anyone who claims otherwise, as those may have been exceptions but are certainly not procedure.
