I have no problem with their lawsuit. Problem is they could not convince a jury thaat Apple infringes and at that point should have dropped their case. I am not a big fan of the ITC.

I do not think I posted in that that thread, but given that Apple has been in the movie business since it started selling and renting movies in iTunes (as early as 2005) and that if a company does not protect its trademark it risks losing it, I see nothing wrong with their lawsuit. Its plans to expand nationally makes it a target, especially as Apple has been releasing more and more high profile films theatrically.

Nope it is defending principle. No problem with the IP lawsuit against Apple, nor with Apple defending itself against it. As I mentioned, once it could not convince a jury that its case had merit, Masimo should have accepted defeat and moved on. Their CEO was so fixated on this consumer play that he bought Sound United so that he would have a consumer distribution network that he would be able to use to get his watches into the market.

I am always amused when people bring up Apple’s size in respect to these suits. Either Apple is right or wrong on the merits of the case, and it is just as funny when people say “Apple’s a huge company it can afford to pay XXX for YYY.” The problem with that logic is that there are a million companies that all feel the are owed for something, and Apple clearly cannot afford to pay them all. That is why they aggressively defend themselves over these cases.

Indeed. Tim Cook is a miser. Tightwad Tim seeks to maximize profits even if it harms the most important thing in the entire world, which is people's health.

Your argument seems to be that Apple should have agreed to Massio’s terms and paid their requested $100 per watch, for a feature that seems to have very little impact on almost anyone’s health. My bet is if they did that you would be complaining about their greed in raising the watch’s price.

Indeed. It’s sad to see people opposed to the little guy. It’s sad to see people punching down.

Whenever Tim Cook does something unethical in order to maximize profits, those Apple defenders say he’s doing the right thing because he has a “fiduciary duty” to the shareholders. As if that’s the greatest moral good!
