Or maybe Apple has spoken to all the people, not just the person who is suing and a few anonymous sources, have seen all the actual performance reviews (not just the claims of the person suing) and they do not believe the accusations.

I understand your view. Mine is somewhat different in that we did not hear any detail of the sexual harassment complaint (nor anything at all from the person who entered mediation). It is really hard for me to judge the situation without that information (“he complimented his appearance”, “he sent an inappropriate text message”, etc.). For me, it is impossible to know if these were actually inappropriate, or if they were completely innocent and only received a negative reaction because the other male was uncomfortable with him being gay.

I don't care what judges decide

My point was not that I wanted to hear what the judge decided, but that without it going to trial we are unlikely to ever learn any of the details. It makes the situation very unfair in my view in that we did not hear anything from either of the parties to that case, only from anonymous people possibly with axes to grind.

To me, one of the important things about the presumption of innocence is that until one has heard both sides, it feels unfair to form an opinion.

That your opinion of his has gone done after only hearing one side is exactly why these cases are such an issue, in that just the accusation does a great deal of damage.

This is the part where your reaction feels unfair. We really know nothing meaningful about the sexual harassment charge in that all the quotes in the article have no detail, and none come from the person who went into mediation. We have no idea what the settlement is/was. I will say that it would really surprise me if this was a black and white case of harassment and Apple allowed him to remain at the company. The legal and reputational risk are extreme.

The second case, mostly a pay discrimination case, is really the prime source for this piece. On this one we are way more likely to get more information. Maybe he is an abusive boss, may he is not, maybe that was added to make the basic employment discrimination case seem more important. I have no idea, but I hope we will find out more if the case goes to trial.
