I think you're right about the design flaw.

Before comparing: an Audio CD player does not go much higher than 1X CD speed and other laptops, in most cases, have a cd tray with a mechanism in the center to clip the media on and hold it tight.
The MacBook Pro has a slot drive and a thin one at that so there is not much room for that cd to wobble in case there is external spin applied. The mechanism holding the media in place is probably not as strong as the clip on design.
And the whole thing is just spinning way too fast. I think that they could use some accelerometers to reduce the speed of the drive in case we move it from one place to another.
 
I don't know the exact nature of the damage but I've heard Apple had at least one bad batch of Snow Leopard upgrade DVDs with a number of people affected -- sounded like some sort of physical media damage. The results were similar: trashed installations from what I've heard.

I do sympathize with the original poster's rage and grief, but Apple fairly compensated him in the form of a (well, promised) expedited replacement DVD at no charge. Had I been in his shoes, I'd have had booted off a Leopard DVD and done a Time Machine restore, and been back in business (for the time being) shortly afterwards with a minimum of hassle and only a bit of my time... and then await the replacement disc.
 
Insert your AOL CD in the MacBook Pro.
Wait for the high pitch spinning sound.
Hold you Macbook Pro and pivot it around different axis.
You'll hear a scratching sound.
Eject the CD, and look at the pretty scratch rings.

Moral of the story, don't move your MacBook Pro when you're using the optical drive!

I don't think Apple is at fault here, it's simple physics.

Why is everyone giving this guy such a hard time? He says there are scratches, but just because you cant see them in an image taken from an iSight camera, you say he's wrong and there aren't any scratches?! Do you seriously trust the image quality of an iSight camera that much!?

Yes, when a company are producing thousands of products there are likely to be one or two defected items in the batch.... but that doesn't mean you should disregard the OP's situation and insinuate he is a fool for wanting a little sympathy. He's lost all his files and all you can say is "well you should have backed up then shouldn't you?"... yes, he should have, but maybe next time offer a little sympathy in your post, as well as the advice.

I swear, the attitude of a lot of people on this forum is becoming more and more obnoxious and condescending each day....or is that just to be expected from hardcore/fan-boy mac users?

If we continue writing on this thread, in the end the OP is going to have to apologize and go to California to wash Job's car.
He got a scratched DVD, and that's Apple fault. Repeat after me: if the product is defective out of the box it is manufacturer's blame.
He should have backed up the data? Sure! that's exactly what I am doing tonight right before upgrading my MBP. Should he expect that the DVD is in good condition? Well, that's what he has paid for.
Maybe compensation is not in order, but at least they could have sent the DVD by O/N shipping.
 
I have had plenty of laptops before that have never done anything like this. I have also had CD Walkmen that had no problem with physics and that was 15 years ago. If this happens anytime the drive is in motion and you move the laptop, Apple is ignoring a serious design flaw. This is a laptop, not a desktop.

Here's the real kicker - Apple told me they sent a replacement overnight on the 5th and I still have nothing. Fortunately I gave up waiting and borrowed an upgrade disc from somebody else.

As an update on my issue - I STILL DON'T HAVE THE REPLACEMENT. Apple's support department has been pathetic with this. Multiple calls and emails from me and they have no idea what happened to the first two support cases where they said they were sending a replacement on the 1st and 3rd respectively. It's now the 20th and I have nothing. Fortunately I was able to borrow an upgrade disk from somebody else, but I just want what I paid for.
