I got a message from my niece last week that was a string of 40 different emojies. on the weekend she asked why I didn't send her any Emoji's back... I had no idea what she was trying to say.
 
What a mess and your think Qualcomm was the guilty one. If this gets out of hand, it could delay the X even longer if Apple has to pull the feature.

This will have no effect on the X production or launch. If by some chance Apple has to remove or rename this feature, it would be done via a software update. But I think we already know Apple is going to win this lawsuit for the simple fact that the 2 products are something entirely different. The only thing in common is the name, and Apple would just have to pay a fine, maybe a couple million depending on how much the name is actually worth.

Assuming that is accurate, if you want to sound threatening then names like “The Emoji Law Group LLC” doesn’t quite pull it off. Maybe “My dad’s bigger than your dad LLC”.

They weren't trying to sound threatening, they were acting as a front for Apple. This is SOP for large corporations. Why they do it shouldn't require a lot of explanation.

Absolutely. I find this kind of bullying totally disgraceful, just like in the Nissan case I mentioned.

A lot of people see Apple as being squeaky clean, however they do have a very dark and sinister side.
 
Whenever Tim Cook tries to act like a progressive, remember he knew he was stealing this trademark from the little guy and could care less.

It's called business Marty. Apple is definitely gonna pay him way more than he would've ever made from it.

There's a big moral difference between buying something ahead of time...

... versus stealing and paying later simply because the owner has little choice by then.

Pretty much the same way Apple uses some patents.

Some companies' stance seems to be that if they don't like the price of something, they'll use it anyway, and then either fight to invalidate the ownership, or pay the penalties.

All agreed, but IMO, the article doesn’t paint the rosiest picture for Apple.

Unfortunately, Apple, the Corporate entity has been behaving in similar ways since day 1.

I love many of Apple's products that they have. I own several. But I have also followed this company from day 1, and they have almost always (this isn't anything new under Cook) been very ethically deficient. It's frustrating to know that they do make good products because most of the time, I don't wish to support their behaviours.

Does that actually mean how it reads? Apple went to the Patent Office and essentially moaned like a child in the hope they would just cancel it? "But it's not fair - we wanted that name"

And should that have happened, the guy would just have been told to suck it up and think of a new name?

I'm glad Apple didn't succeed.

I don’t we why it would be grounds for delay as it’s mainly a softwear based. They can deactivate it via a update. I personally do not think they will unless order by a judge to. This thing will settle out of court like every other petty lawsuit.

It's exactly what they did.

Apple didn't care for the years he used it for the title of the App. But now they want it, They took their expensive shiny lawyers to the government agencies which they have incredible power with, and demanded reopening of the files to check for any possible error that could invalidate the trade mark.

the irony in his is most people here think Apple is all about honesty and ethical business practices. Reality is they use they size to bully the smaller businesses. I use Apple devices because they work for me. So I’m not a hater

Feel sorry for the guy but it does sound like they left the doors open to Apps by screwing up the company it was registered under. They are using a technicality to get it cancelled which is the sort of thing that is probably pretty black and white. If the company didn't exist it can't own the trademark etc.

Funnily enough, I checked and Emojimation is also already in the App Store. I kinda feel like this is like kids nowadays trying to pick usernames, you might have to start using names like Animoji6257, since all the good ones are taken.

Apple needs to just pay the guy a ton of money in a settlement. Give him a cool $1 mil. He’ll be happy and set for life (if he uses it wisely) and it won’t even dent Apple’s legal budget. No one ever has to know. Problem solved.

Apple’s stupid for letting it get to this point publically. PR damage isn’t worth it Apple, you should know that by now.

Ha Ha! "$1 miiiillion". You sound like Dr. Evil in Austin Powers. Think again. $1 mil does not set you for life in this day and age...unless your expectations in life are set very low or you live in some 3rd world spithole. Also, they are not "giving" him anything. He will be TAKING from Apple and it will sure be alot more than a cool $1 mil.

Apple has every right to contest the name “Animoji”. It means animated emoji, and if the product you’re selling has no relation to the name of it you’re going to have a hard time holding that argument in court as to why someone else cannot use the name for an actual product that does exactly what the name states.

Do you even know anything about the Qualcomm case? In a nutshell, Qualcomm is charging Apple for technologies they did not develop but Apple themselves did. Qualcomm is basically saying well your technology wouldn’t be what it is if you hadn’t used our product.

Take a step back and look at the broader picture instead of bashing Apple every moment you get.
