There are frivolous lawsuits, but I don't think this is really one of them.

He isn't asking for millions of dollars or filing a class action; and he has a legitimate grievance. He doesn't want to update to iOS7 (which he doesn't have to - maybe he doesn't agree with updates ToS or whatever). He's just lost 3GB of space and can't get it back.

Apple could fix this with a simple "automatically download iPhone updates" switch; similar to what they already have for App updates.

Typically I wouldn't agree to such a toggle, but when the cost is 3GB it kind of sways the decision.

Losing that 3GB can significantly change the nature of the device that you bought. That's why he's filing a lawsuit.

He sued in small claims court for $50, plus a way to erase the update and keep it from downloading.. yes.. scummy lawyer trying to get rch for sure :rolleyes:

It took 45 posts for someone who can actually read before commenting. You guys are ridiculous if he doesn't want to waste all of his space he shouldn't have to. Apple should give a way to delete the update. Simple really he just wants to be heard and got got what he wanted. You guys should actually try thinking before bashing someone.
 
After a recent visit to an Apple Store about my phone's battery, I'm actually starting to agree with the plaintiff's comparison of Cook to Jobs. Iconic COO - doesn't understand the other facets of the business, like design, retail or even just providing value for money. Here's hoping Angela rights the ship back to customer-oriented service, and the next iOS update smooths off the numerous rough edges.
 
People that single themselves out like this should be thrown onto an island with others like themselves. People act as if someone cut off their fingers or something .. its a phone, get over yourself.

Guys, for God's sake please RTFA.

  • The man asks for 50 bucks only (other than Apple "fixing" this).
  • It is the lack of disrespect that pisses him off.
He has every right to keep his current OS without such a penalty, and he should if he is using an iPhone4. iPhone4 is still a phone that is very nice to have, and not all of us upgrades every year or two.

This would be a decent solution. I agree that normally it wouldn't be needed, but I can see how 3 GB is too much. If Apple throws in a toggle button in Software Update, then everybody should be happy.
 
Simple solution: Install the iOS 7 download and get over yourself. iOS 7 is great, live in the now and not in the past.

I did it and I'm so sorry I did. Even worse-since onto er 16th apple cold me from downgrading g back to ios 6 for no real reason. On your iphone 5 it might be ok. In the 4s it is a nightmare.

what a bunch of whiney ***********. Why don't they just install iOS7 like most of the world? You're going to have to do it eventually, legacy support never lasts long. Everything that works in iOS6 works in iOS7 except for jailbreak. The only difference is that iOS7 has a ton of more and useful features which is hard not to like, but aesthetics. If you don't want to upgrade based on aesthetics, that's just vain and silly.

Exactly this. People insisting on sticking with iOS 6 really get under my skin. There's no need for it, regardless of what bonkers statistics and things you can come up with for why it's better than iOS 7. Update and live in the current.

Exactly!! Most of us couldn't wait to install the beta version of iOS 7 lol.
 
I don't think this is a frivolous lawsuit.

Wether you like iOS7 new look or not, there is no denying that it does not run as well on certain iPhones or iPads and those users do not plan on upgrading. Forcing those users to have to store 3gb of data they will never use and cannot clear isn't right. Especially for those 16gb users who were already tight on space.

If Apple would have remedied the issue in a timely manner that would be another story, but here we are a month later and they have not corrected the issue nor have they stated that they plan to.
 
I hope this guy succeeds. Apple automates as much of an upgrade process as possible and that is great but there should be a way to remove it so that space on the device isn't wasted. They charge a premium for flash storage, they shouldn't do something which amounts to them taking it away.
 
No idea what he's talking about with the Steve Jobs thing.

This sort of software feature is EXACTLY the kind of stuff Steve loved. Controlling the user experience, giving them less options.

Just another person to romanticize the past.

It did, I remember being pissed about it because I didn't want to upgrade right away because of apple maps. I was already not having enough space on my 16GB phone, then the update just filled the rest without asking and wouldn't let me delete it. I am honestly glad they are getting sued for this because it will bring the issue to light. I don't mind having an auto download feature for people that want it, but they need to let you turn it off and delete the update without installing if you so choose.
