Apple TV 2 - safe to update?

Just got my hands on a Apple TV 2 and its running 5.2.1, the system is offering me an update but I am not sure if its save to update if I want to jailbreak this thing?

I think the highest jailbreak available is for 5.3 and I'm pretty sure that's a tethered jailbreak.

So looks like the JB updated the thing to 5.3 so now its tethered.. damn it. Anyway to avoid this and downgrade?

It is jailbroken now and I'm looking at this atv Flash thing.
