I bought a series 4 Hermes edition for me and my wife but, I haven’t been able to justify the extra spenditure for my watch and have come to the conclusion I am good with a standard SS. The problem I have is that I noticed a small scratch at the top of the watch now, will I have a problem exchanging it for another lesser value watch? Or just returning out right? The leather band is pretty much unused.

It likely won’t be an issue if its not immediately noticeable, Assumingly you’re also within you’re in within the 14 day return period.

I mean I can see it but I also know it’s there. I’m not sure how strict Apple is with this I’ve never had to return anything to them really. Yes I am within the 14 day window.

If you're in the 14 day window its not a problem as long as the watch is complete (charger / band) and lights up.
