Well, for one, I don’t believe it is the intent of the legal system to prevent employees from being offered higher salaries and more benefits for their skills and expertise.

If Apple is willing to pay them more, why shouldn’t they take up said offer?
We would have to see Masimo’s non-disclosure agreement(s) before that could be answered.

I have a question: Don't all the smartwatch manufacturers use the same technologies that Masimo is accusing Apple of ripping off? I have no issue with them going after Apple, but I feel like they should go after every company infringing on their patents, if that's the case.
 
I’ve been a Watch Ultra user for about a year. It‘s a great device. Support Apple and get an Ultra before January 10th 👌

Maybe it would be wise to wait for the redesigned series X/10. I have a Series 7 and a redesigned Series X/10 sounds like the upgrade/change many of us have been waiting for.

I'm thinking about a 9 or an Ultra so I don't have to deal with the potential band change/redesign. I have a lot of bands, and prefer to use them as long as possible.

I'll probably just keep my scratched-to-hell series 6, though. There is really nothing the newer models offer that I care about.
 
Great for Apple at least for the next two weeks. Wonder whether the ruling will be in Apple's favour.
 
I still hope Masimo get at least $100 in compensation retroactively for every Apple Watch sold. Apple would still have a large margin. Violating patents should never be profitable.
 
I honestly don't like the lie Apple has been pushing with these 2 watches. They physically infringed on a company's patent and then they come out saying they'll solve the problem with a software update 😳 Stop Lying, you can't make that make sense.

Well, if the software update disabled the blood oxygen sensor completely... that would solve it. 🤣

i still find it strange how huawei releases a smart watch before Apple did with the s9 and awu2…and wouldn’t you know, they share A LOT of similarity. Makes you wonder who copied who…

The issue isn’t paying more. The issue is taking trade secrets thus violating patents.
 
My guess is that Apple is very confident in what they will be presenting during the appeals process.
Agreed. In my engineering experience situations like arise only when one company, in this case Apple, is very confident that their technology does not infringe any patent and that they can safely proceed to mass-market. If there had been any doubt there would already have been discussions on licensing and royalties. Doesn’t mean that Apple are right, of course. That’s ultimately for the court to decide. But sure does mean they are very confident.

Glad to have a ban lifted temporarily. Hopefully, the ban will be lifted permanently with appeal success or if appeal is unsuccessful, with Apple’s efficient and effective corrective actions, the watch will stay in sale forever. Keep calm and be successful! 😊

Except that Masimo is using their patents for active devices.

This type of device is extremely difficult since there probably are not a whole lot of ways to do it. So Apple poaches know how from Masimo; are those new Apple employees suddenly supposed to not use their knowledge?

I've been through something similar in my career; this type of **** happens all the time in the engineering fields.

They should find a way to work together.
It is a debatable thing… if they hire a bunch of engineers with expertise in a specific field, and they are offering them a better contract, are those engineers supposed to NOT use their knowledge ? It is unreasonable…
The concept of IP is flawed in some specific cases. You cannot patent a wheel, because someone is going to use it, sooner or later.
I’m not saying Apple is right, but I’m sure Apple Watch is not something Masimo is selling or willing to sell in the future, so the entire patent infringement here is debatable in its principles.

The majority of those patents were subsequently invalidated in court. Only 1 held, and even then, there is still a chance of it being overturned upon appeal. So whether Apple (or any other company) is violating a valid patent, or whether said patent in question was invalid to begin with, is not set in stone at the moment of it being filed. It's also possible that Apple did instruct those employees to do their best to design around those patents, and despite their best efforts, still ended up violating them unintentionally.

After all, engineers are not lawyers, and it's the court who ultimately decides, not laymen engineers or corporate lawyers.
 
Got a Series 9 for Christmas and coming from a Series 4, the max brightness is dark environments is TERRIBLE.

Why would Apple not allow user control over this? They don’t allow the ability to turn off the auto-brightness. Really frustrating that this new expensive watch is so dim in low light conditions on the brightest setting.

Really hope this is addressed in a new software update.

This is my first Apple Watch and that was my one complaint. I thought something was wrong at first!

Well, waiting for the series 11 or 12 might make more sense in that case. Personally, I’ll probably wait at least three months before I buy the Series X/10 in case some early adopters run into issues with the magnetic clasp design or something else.
