This really sucks, I hope this gets rectified by June 2024! I was able to replace my Series 6 with a new unit for only $70-80 (without AC+) because the battery health decreased down to 79%. If this ban continues infinitum, then I will have to purchase a brand new AW instead. Insane!
 
There seems to be a misunderstanding about what this means. From what I read, Apple will not be able to replace these devices out of warranty until the ban is lifted. If you have AC+, you will be covered like normal. If you don’t have AC+, I would absolutely try to get it immediately as a precaution. I think you can also continue to renew if you’re at the end of your current coverage (not positive though).

Apple is getting the relevant claims of the patens invalidated for about a dozen Masimo patents due to prior art.

In the initial finding from ITC, the administrative judge found Apple breaking a lot of claims of several patens. When the full ITC dismissed a lot of it and found only Apple breaking 5 claims split across two patents.

My point being that it's not entirely clear when a product breaks a claim in a patent when even people in the ITC disagreed.
 
They’ve been raked over the coals their entire existence and have been through pundit declared disasters as well. They’ve always been able to withstand it. They don’t care about what the nerd herd thinks.

But I do smell a class action over not being able to get your Ultra 2 replaced. That’s why I think there will be a resolution sooner than later. It’s all a chess game and brinksmanship at this point.
So you're going to sue the U.S. government as they are the ones that issued the order. Anyway what would we get, a $5 Apple Card?

It’s up to you, but I would get it just in case. You could go month-to-month, assuming that it works in this scenario — and I’m not sure if you can move from month-to-month to annual. If you can, this might be a good temporary plan.

They can indeed repair them, just not replace them, as a 'repair' option.
 
People love dogging Apple whenever possible, but take for granted that they depend on their products. If you agree with the lawsuit, then agree with there being no Apple Watch, repair service or don’t complain when the price of the watch either soars or comes back to market without life saving technology included. The lawsuit is really against those who want an Apple Watch, not just Apple.
 
Rossmann is an idiot and effectively more entertainer than anything else these days. His videos are ALL whiny complaining about anything he can think of. His channel is trash.

Indeed, he used to do good with the repairs. But these days it's just a whine fest. Everything he says can be said in 10 seconds, while his videos almost all take 10+ minutes for the ad-money. He does have some points, but basically everything he says is: "Big company does something I don't like, big company is evil! Rinse, repeat 100x in one video."

Which is usually the case with most complainers. They complain only until it hurts themselves. And then it's too late to reverse course and they'll be either losing more money, or they won't be able to at all.

This patent is going to expire in 2028, so the chance is there that next 4 years there will be no blood-oxygen monitoring in the AW. This is a very big reason why Patent Law needs to be changed, a patent should not be allowed to force a company to not include a technology. Sure they should pay for it (would even be court mandated) but a sales ban should be impossible.

I've been paying AC+ monthly on my Ultra 1 ($4.99), just because it's extremely expensive to repair if something were to go wrong with this. I was going to cancel this Jan 1, but I just may keep it going instead.
 
All the blame lies with Masimo on this. The bulk of these patents (15 of 17) have been invalidated by the Patent Trial and Appeal Board, and when it went to trial Apple had all but one juror agreeing with them (which meant it was declared a mistrial). Even the ITC wasn't unanimous on this ban decision.

Apple is also suing Masimo for their W1 watch, stating that Masimo has used these lawsuits to gain access to source code and confidential information which they then used to develop their own device.



Everyone can think this is Apple being a bully, but it sure reads different when you see the actual facts.
Yeah, Masimo is totally to blame for Apple infringing its patents. :rolleyes:
