My early 2008 macbook pro started acting up on me recently, the screen went pink and blue blotchy and shortly after went into a kernal panic everytime I tried to boot up, even after following the basic steps like resetting pram, holding shift, removing battery, and booting into single-user mode and running applejack's disk utility. basically, similar symptoms to what had me get the graphics card (NVIDIA 8400) replaced last spring by applecare.

I have applecare and after the phone calls with them had me sending my laptop to an Apple Authorized Service Center. Now, I am currently outside the country and do not plan on returning for at least a year. I am in the Netherlands-Antilles (Caribbean, not Europe) and I used a service center I found on St. Maarten.
The guys response to me (after a huge hassel just to get the laptop to him) is that the battery was 'consumed' and $$ to replace it plus a $90 diagnostic fee and claims "I didn’t see anything wrong the screen blotchy."
Yeah, maybe you didn't see anything because you didn't even look?
My question to you all is, should I be paying this diagnostic fee? What is the point in buying a new battery off of him when the thing still won't boot? And of course, is there a known issue with batteries in apple laptops that will induce graphics-like errors?
I feel like I'm getting scammed, Apple needs tighter control over their authorized dealers.
