I'm trying to get the Appstore application but its not going anywhere, i did do a software update but its not puffing anything up.

I'm using a new macbook pro with Snow Leopard (late 2010). And it should just be downloadable on the website, but unless i totally missed it isn't.
 
It should have come with the 10.6.6 update and installed on your dock automatically without you needing to download

You've checked your Applications folder I presume
Not being smart here, just not understanding (along with you) why it isn't present

I checked it:), plus tried to find it with Alfred or spotlight, nothing was there.
 
Can't i just download it as a .dmg?

Did you clicked on Apple icon on the left corner? There should be App Store section here. I think you cannot just download a .dmg file to install App store because i requires a system app (which you already did)
 
that just happened to me. close the app store and try again, for some reason i had to close and restart it twice...
