OP, it seems like you are wanting to have you cake and eat it too. You either keep the phone and suck it up and pray a software update fixes it in the future (or pray that Apple recognizes a hardware problem and does a recall or something else to make it right) or you take it back. People harped on you about where the $10 charge is coming from because in your original post you talk about wanting to get a refund from Apple because you can't use 3G on your phone. That's not going to happen, nor is it reasonable. Situations like this are exactly what return policies are for. Take it back, or get it exchanged, but don't think someone is going to partially refund you. Especially when your basis for the partial refund is fatally flawed.
 
Ok, then your post makes even LESS sense.

Lets say you buy a TV. You find out the TV is broken. You then ask Sony to pay you for your cable bill for the month. It doesn't work that way.

If it doesn't work, take it back. Apple owes you your money back. You'll get no argument from me.

But they don't owe you money for other services. I thought you were blaming AT&T and wanting them to give you money back, but apparently that's not it. This is an even weaker argument than what I originally thought you wanted.

however, he has since been educated on the fact that at&t charges $29.99 for internet access on all smartphones, not just the 3g iphones.

at this point, i think he's come around to the fact that he's not entitled to a refund from anybody, but just wants apple to fix their reception issues on the 3g iphone.

We get that. Which is why he needs to either suck it up and wait it out, or take it back. We all know there are 3G reception problems, no one is debating that, and there are plenty of threads out there for that discussion.

I'm on my second 3G iPhone (seperate problem). It performs just like my first one in terms of 3G service. I guess I'll "suck it up" as you put it and wait for a fix.

The only reason I started this thread was to suggest that perhaps myself and others having the same problem are entitled to something from Apple since their product is so deeply flawed.

You all are far too in love with Apple to understand me. I see that now. Thanks for the posts.

The thing is, and it has nothing to do with being in love with Apple, that the iPhone is exactly like every other item on the planet. If you are not happy with it (i.e. it is deeply flawed in your opinion) you can take it back. That is what you are entitled to, getting your money back.

I cannot imagine an apple or att saleman selling a 3g product to a person in a non 3g area.

Where in Pittsburgh are you? I'm currently downtown at Point Park University and have 5 bars. I normally have between 3 and 5 bars wherever I am. There are a couple spots in my building at my day job where the signal drops to 1 bar or nothing but it seems to be just a couple rooms.
