AT&T question - buying two phones

Hey

I pre-ordered the X and paid the full $1K up front. I then tried to buy another one and it wouldn't let me. It said the first device had to be activated before I could purchase another phone.

I'm with AT&T and was eligible for an upgrade. Since I paid cash for the phone why is upgrade eligibilty an issue? My confirmation says AT&T terms: No Commitment

If I was to sell the iphone I pre-ordered, when would I be able to purchase another one?
