An EFT? I love this board. I love how everyone on this board is magically an ATT CSR, and can now make assumptions about what people are doing. Great. You got it. Now, if only you guys could apply this sort of deduction to something productive in life, we'd have something!

Regardless of what the ToS say, you don't know if this guy is selling it for profit. Maybe he is. Who cares. That's how life is. His business should be none of your concern. He asked a question about this situation and apparently previous posters have taken the liberty to interpret the ToS.

OP, truth be told - it is in the ToS, but that hasn't stopped anyone. I'd go back somewhere or call somewhere else and see if you can get it to go through. The posters on this board complaining are hardly aware of half the crap that goes through ATT's fingers, let alone those 'flipping the iPhone for profit'. And if you really are flipping it, hell, more power to you and you beating the system! ;)

Today is day 31 of owning my iphone 3GS. I called AT&T to cancel.

They told me my billing cycle runs from the 14th to the 14th and I cannot cancel until then. They can only "suspend" my line.

I'm not sure how this is possible. I started a new line of service and purchased my iphone on the 19th of June. Shouldn't my billing cycle start the day I signed the contract?

They are now charging me for an additional month of service that I do not intend to use. How is this possible/legal?

I want to pay for the 31 days I have used + the ETF. Has anyone else had a similar issue trying to cancel a new line of service? I'm wondering if I should pay the bill with my AMEX then dispute the charges, or file a complaint with the BBB and FCC...

They never told you that you cant cancel the contract. I guarantee that. They said that they will future date the cancellation to make the next bill not as confusing because you are in the middle of a bill cycle. Maybe next time you call in, you should listen to what they say.
 
First I'll say I would agree with the OP, but Dave's post about no prorated last month kind of takes away his argument, although if that quote was not there and they were still doing this, I would feel different.

Now, for all you complaining of the OP just trying to make a buck and work the system are complete morons. Guess you never had a finance or economics class.

Ever hear of a word called arbitrage? Yeah, when you can buy something one place and sell it somewhere else for a profit because markets are not efficient enough to reflect a price change before it is sold in the second market.

The only caveat here is that there is arbitrage, not because the market is not efficient enough, but because AT&T is too stupid to change their ETF amount. AT&T has known since the first iPhone that there was a "black market" (i.e. T-Mobile) for the phone. So, they could have decided to change the ETF specifically for the iPhone (I mean, they were smart enough to make its data plan mandatory, which is the only phone to have that requirement) to state the ETF for iPhones is $400 (whatever amount is necessary so AT&T is not getting "screwed") instead of $175. However, they didn't do that, so that is their own damn fault.

What do you say about me working the system then? I upgraded my eligible line of a family plan in April, bought a refurbished 3G for $149 and sold on ebay. After all fees, I cleared $290, knowing all the while I was "screwing" AT&T with my plans. Since I was going to keep their service anyway and I have phones that will last me until my next upgrade, I must be a terrible person for working the system this way, right?

Ya - I can only IMAGINE how evil AT&T would be portrayed if they did THAT. Seeing as they are already EVIL for insisting on a data plan and not offering upgrade pricing for some and not others. Add to that the hoopla over what tethering costs might be (which no one knows yet but they are still in a tizzy). While a "viable" solution - the outcry on these boards over an unfair ETF would be deafening!
 
Its bull **** from ATT. Are you willing to take them to court, be the first. Its stealing if you ask me. Dont give up

It's not stealing. It is a part of the contract that you sign when you get service. Verizon is the exact same way. The line stays suspended until the end of the bill cycle. The bill cycle is random, so it may be any day of the month.
