Exactly. This thread is pointless.

1. Never a written policy for 12 months with certain customers. It was more of a perk if you paid $99 or more on primary line.

The standard upgrade has been 20 months give or take for years. Its been on their official webpage for at least the past 2-3 years.

2. Both sprint and Verizon got rid of similar 12 month upgrades aLSO. So its not a att thing.

T-Mobile has been worse. Like 22 months for full upgrades for past 4-5 years.

If you don't like it. Leave or go prepaid.

Well that's your choice but my business has over 1000 positive customer reviews without a single negative one in 10 years.

If I had a customer who I had under contract I would never start changing my policy for the specific purpose of padding my bottom line and screwing my customers into a 15% price hike. This is what AT&T is doing and it's unacceptable and I hope I'm not the only one who thinks this is bad.

To be very clear, I would never have entered into the contract in the first place if I knew that AT&T would make materially adverse changes to it mid way through. That's why there are laws specifically forbidding companies from doing just that.

Thing is, AT&T never put this in the contract. They didn't advertise this. They offered it as an extra bonus for being a good customer with them but they never said it was part of the deal.

So they didn't break contract so you're just trying to get out of a contract and you breaking it without penalties. Otherwords, you're not living up to your end of hte bargain. And convincing companies it's not worth giving extra perks cause in the long run it just creates entitlement customers who get pissed if the company decides it can't afford to do that anymore.

AT&T never broke their contract when they stopped doing that. They never made it part of the deal, they just offered it extra!
 
I cannot believe the number of people that are defending this policy change. people here will be the first to complain about facetime requiring a mobile share plan and everyone losing their unlimited plans when the LTE iPhone is released. but this they defend AT&T for? Just because it wasn't in any contract? (that we know of) One poster in this thread said "Because AT&T was nice to you once in the past" No AT&T had a policy that they followed for 5 years. Now like axxing unlimited, forcing mobile share plans, charging for tethering even if your on a tiered plan they changed another policy for no other reason but greed. wake up people.

I don't have 4G LTE in my area at all, only 4G HPSA+ which means T-mobile and AT&T would be identical.


Technically I have t mobile where I live too. Funny thing is that when people visit they only get edge.

T mobile has the worst frequencies for penetrating walls
 
It was nice when AT&T would give yearly upgrades to people that had a bill that was over a certain amount. Verizon used to do this years ago but they got rid of it even before AT&T. I do think that AT&T is probably going to lose customers to Verizon this time around. Many people stayed with AT&T because of yearly upgrades and slow 3G speeds on Verizon but they will now have an LTE iPhone which will be much faster on Verizon in many cities. AT&T might have kept more customers that are now thinking about switching if they had kept their old upgrade policy but that was their choice to make.

When my phone works, I have always felt like AT&T was superior to Verizon (I switched from Verizon when I bought the iPhone 4) but there are many times when I am standing next to someone using a Verizon iPhone and they are texting away while I am searching for signal. I still haven't made up my mind yet but I am leaning towards switching because of that not the upgrade policy since neither company offers yearly upgrades anymore.
 
Hm...according to OP...it seems like ATT would be losing money at some point.

Does your credit card company 'forgive' your debt and let you buy another tv every year?
 
I agree with you but good luck getting anyone to agree with you here. These are all by the book types who think because the contract doesn't promise a free upgrade every year then no one should get one and no one should complain even though they changed a policy that has been around for 5 years.

AT&T has the advantage tho. Sprint has no LTE and horrible 3G coverage. Verizon is more expensive and a more strict upgrade policy not to mention falling back to slow 3g speeds if LTE isn't available.

So what i'm going to do is either pay full price for the next phone get it unlocked and get my money back by selling an unlocked phone for more next year well getting a fully subsidized new phone. or pay the early upgrade price and just eat it.

Actually, after 2 calls to Verizon CS I got a crapping out enV3 on a secondary line upgraded about 3 1/2 monts early to a iPhone 4S(it wasn't for me though :( ). However, they are usually pretty strict on iPhones(or any phone that is in the preorder portal).
 
no it would be like paying company a $17,640 per year for their best car with 4 wheels. Then getting a lincoln because bmw's haven't been rolled out in your area.

All the while company b has been offering a lincoln for $12,900 per year.

Then one day company a decides to jack up their net price per year to $19440, which you decide is far too much more than company b so you use that as a materially adverse change to get out of your remaining contract with company a.

In fact it's exactly like that, if you divide the numbers by 10. ;)

Anything's possible. Likely? No. You'd have to pinpoint where in the terms you were guaranteed 12 month upgrades. AFAIK it was never documented in the contracts. You should have what you need to answer your own question in the terms you agreed to.
 
I don't recall AT&T's upgrade policy ever being printed or used as a sales incentive. More often than not, it was used and considered a bonus, an extra, rather than something guaranteed.

That said, even if the OP were able to prove that it was materially adverse, the change occurred months ago. If they wanted to get out of the contract with no ETF, that would have been the time to do so. By waiting and not doing anything within a timely manner, they (for all intents) agreed to the new terms.


At the end of the day, regardless of what the sales people say and ignoring what AT&T may (or may not) have done historically, all that matters is what's printed on the contract the OP signed... the one that says 2 years, no early upgrades.

Regardless of legality, I feel this is a bad financial move for AT&T for several reasons:

1. 12 month upgrades bind people to contracts. As long as they succumb to lure of a yearly iPhone upgrade (which most do), they will be hooked forever.

2. The reason why a majority of iPhone users upgrade yearly is because selling their old phone generally covers the cost of the new phone. The decision is a no brainer if you're not losing any money. The upgrade is essentially, free.

3. Many people often have trouble deciding between two plans. The unwritten policy convinced them to go with the higher plan. In my case, I used to talk on the phone a lot more. I still kept the higher plan even though my usage dropped partially because it pushed me over that mark.

In my opinion, holding a customer until the 20th month is too close to the end of their contract and makes deflecting easier. I know many many people who always preferred Verizon, but when the Verizon iPhone finally came out, they were too addicted to their free yearly upgrades that they're still with AT&T today.
