iPod Back to School 2010 Question?

If I purchase my Macbook Pro and iPod Touch on the last day of the promotion, get my rebate then go back because my iPod Touch is 🙄broken🙄 would I get the new one because I know they update all the iPods the day after the promo ends, so would I get the old or new iPod Touch if I wait maybe a week to go say how it... 🙄broke🙄
