That actually is the carriers who demand the installation of bloatware. Luckily I can just root my phone and rid them in a matter of seconds.

Mine is rooted and cleaned up. But my rom is a standard samsung rom (not branded) the bloatware are those crappy samsung apps like touchwiz and their crappy app store among lots of suspect apks like mobiletracker.apk.
 
Bit of a pyrrhic victory for Apple. They've won on a minor point - which will be easily worked around by Samsung - yet they have questions raised on the validity of some of their software patents.

The good news for Samsung is that the injunction relates specifically to the current version of these three smartphones. Future versions of the Galaxy S, S II, and Ace that contain revisions to the behaviors in question may be able to get around the injunction. Samsung could, in theory, update the software so that it no longer violates Apple's patent. This would allow Samsung to import the devices into these European Union countries once again.

Samsung isn't the only company affected by this decision, though. Android itself is now in jeopardy.

"Regardless of how Samsung may be able to work around this decision in Europe," said FOSS Patents, "it's a severe blow for Android. In all likelihood, the winning patent is infringed by Android itself--probably not the operating system per se, but by one or more of the applications that ship with Android and without which the usefulness of Android would be impaired in one particular area (photo viewing). Apple now has the first enforceable court decision in its hand (out of many lawsuits going on around the world) that finds Android to infringe an Apple patent."

In other words, this ruling could serve as the basis for Apple to win patent litigation in other courts around the world, leading to similar injunctions. That would be bad for Samsung and every other maker of Android devices.

If 3.x gallery app doesn't infringe the patent and it has the same functionality as 2.x gallery app where is the severe blow?

Not quite. Taps seem to be a logical step as far as I'm concerned. Swiping is a big step. Considering scrolling through pictures previously involved clicking arrows, or tapping an arrow on a keyboard, it seems that touching some sort of arrow would be logical. How do you get the jump to swiping? There were touch devices before Apple came out with the iPhone. None of them had swiping movements like Apple's. The reason? It's not obvious.

Also, the patent isn't on a movement per se. It's on the machine end (i.e. the product and the method to perform the actions by the operating system).

To you perhaps, not to all engineers working, thinking and dreaming about touch for over half a decade. Second, HTC had swiping before iPhone came out. Two strikes, two misses. Want another try?
 
If you're using a modern touchscreen smartphone or an iPad, or an iPad knockoff, then you already have your answer. If you're using apps from an app store you already have your answer, etc., etc.

Apple didn't invent the App Store, Apple didn't invent the smart phone, Apple didn't invent multitouch.

Apple did market a great product called an App Store, Apple did innovate the Smart phone, Apple did buy a great company that had multitouch ideas and introduce it to mass market.

Use a standard Android release then and install something like LauncherPro. I use EVO Deck which is base Gingerbread and Launcherpro to give me a Dock.
 
I haven't used many Samsung devices, but I believe they use Androids stock gallery app. So they are either going to have to make their own quickly, or have Google patch up the way photo's transition in Android. So that means swiping in Android is a patent infringement? That's insane. Its more providing a convenient and quick way for users to look through their photos than trying to steal someone's design.

It would seem that its just for swiping and having photo's slide to the left and right. So instead, you can still do the swiping gesture, but instead the photo does a fade transition to the next photo.

I hope Apple is proud of themselves. This seems like an empty, petty, dry victory. I would cheer Apple on for defending their patent, but it just seems futile.
 
Samsung could well be the winner after all..

This is still very early news but it seems that this is a win situation for Samsung. The judge rejected all claims from Apple except a patent violation that can be fixed with a quick update. Also lets not forget that the specific patent has been invalidated in most european countries. There are only four countries on the list in which it still applies. The biggest drawback for Apple if it continues this litigation will be the loss of mindset share. US maybe a different market but us Europeans think very differently and do not have the blind loyalty towards brands nor are we sympathetic towards large corporations especially when they try to deprive us of options.

I think this is not too bad. Also, note that this is NOT across all EU. Apple did not produce enough documents in all countries or did not pay the bill at other places.

This gallery patent is still NOT applicable in Austria, Belgium, Czech Republic, Estonia, Greece, Iceland, Italy, Latvia, Lithuania, Portugal, Romania, Slovenia, Slovakia, and Spain...


Very true. However, according to FOSS the distribution center is in Netherlands; so cutting off Netherlands hamstrings (or at least impacts) the distribution to the entire EU.

Samsung's route of upgrading the software is probably easier.

I'm not a GUI designer, but you could press an onscreen navigational control (on-screen button), press a thumbnail image, Apply pressure to one side of the device or the other, voice navigation.

The fact remains, there was no phone like the iPhone until the iPhone. Now there are Android/various hardware copies all over the place.

It's not about just a grid of icons. It's about a whole lot of things put together. Whatever... you don't agree. That's alright with me, I respect your opinion.

1) I said sensible. Your solution(s) offers none of the advantages of touch.
2) There were devices that used swipe before the iphone.
3) What is this "whole lot of things" you are talking about? Everytime i go to the homescreen i just see a grid of icons*.

* ill be fair and say that they added some somewhat original things in later versions of iOS. But afaik these are not present in any android skin, so quite irrelevant.
 
I said something similar in another Apple lawsuit thread but the reality is Apple is afraid and they should be.

Unlike the Mac the iPhone and iPad require market share due to the nature of the app store. Developers want to see the devices, Apple wants as many app sales as possible.. in as many hands as possible and the reality is Apple's hardware sales philosophy won't allow them to fend off the Android avalanche in phones, tablets will probably repeat themselves.

It's hard to believe just about two years ago Apple basically didn't even have a competitor until the first Motorola Droid came out and started the Android revolution.. and now Android is the clear leader.

I remember watching IOS 5 keynote and chuckling every time Jobs cooed over "new features". Look, notification bar! Look, a cloud for your contacts and calendars! Look, wireless syncing! If there is one thing where Apple is truly innovative and successful at is repackaging and marketing of other people's ideas as their own. You know, stealing :D

Not available for my specific phone. No custom roms, only crappy samsung ones. Still I use the stock android launcher. Launcherpro doesn't like my phone and crashes a lot, worked fine in my older phone tho.

Would this not affect ALL android smartphones running 2.2 \ 2.3 \ 2.4 running the standard gallery app ?

If so why just Samsung ? :confused::confused::confused: confused.
 
For those of you who have just joined us:

A Netherlands judge said that the photo gallery horizontal swipe/slide method was a valid patent and found that Samsung's phones (but not tablets) validated it.

The very same patent is invalid in most other countries (probably because of tons of prior art).

Does this mean it is bad for Samsung Android to 'steal' the function of a photo gallery, but it is ok for Apple to 'steal' notifications?
 
Why shouldn't this have been patented? Before the iPhone, there was no such thing as these touch-based gestures. It's easy for us, 4 years later to say "that's obvious", but back then it wasn't, and Apple did it first and they did it right. They put years of research and invested millions of dollars into this and deserve to reap the benefits of that.

1. A touched based system isn't new.
2. Doing gestures with your input method to accomplish things isn't new.

If Apple spent millions into research to combine these two, then Apple's R&D department isn't as good as people seem to think....

Gestures was added to a browser in 2000. Opera.
Gestures was added to a video game in 2001 (if not earlier). Black and White.

But somehow you think that nobody was ever thinking about adding gestures to a touch based system years later...

Wrong. The patent doesn't apply in (some) other European countries because Apple didn't update the necessary paperwork.

Try keeping to facts.

I realize that is hard for people so deluded as to keep on finding new ways to rationalize Samsungs behavior, but at least try and not just make stuff up.

Swiping? It's a UI gesture metaphor for flicking through pages of a book. I can't see how anyone would think it isn't obvious.

If you look at Jeff Han's multi-touch demos (which predate the iPhone) most of the multi-touch gestures we're now familiar with are already there. I'm not sure what's so new/innovative/clever about the swipe that it merits protection. I don't think the "We spent millions on researching The Swipe and deserve to profit from it" argument holds in this case.
