No they would NOT need to be online. BUT, the device may or may not attempt to connect to the strongest WiFi in the area. You can see this on passcode locked iPads: sometimes the WiFi will be on before you enter a passcode and sometimes it will not.

Depending on your settings, 10 failed passcode attempts may wipe it for the thief and allow them to set it up as a new iPad. I've sent several emails to Apple engineers in the past over this issue.

The Apple guys put a lot of thought into the activation lock idea. They just need to add one more feature: a supervised device should be able to remove the activation lock through an MDM.
 
It seems as though this person connected to the internet via wifi on their/or someone elses comcast broadband account which are USUALLY password protected. This has been confirmed by comcast. I have been making myself crazy speculating all the details and events that have taken place. I am guessing they probably got into it, connected to the internet, received my second message and lock attempt then maybe wiped it BUT they were connected long enough for my gmail to update and snag the IP. Now I guess I just wait for the warrant to do its thing.
 
My first guess was it was stolen by a previous owner of your apartment. Not all apartments change the locks every tenant. Most places just have you turn in your 2 keys but any number of keys can be made before then. He likely used his old key to sneak in.

It really isn't about the iPad itself. I want to know who the f has a key to my apartment. There was no way it was a common thief, there are way more valuable things more easily accessible. Nothing else was touched at all. If it traces back to maintenance, the management company is going to have to answer for it. They have been giving us **** since we reported it.

If it's truly gone and nothing comes of it I will move on but if there is anything I can do, I am going to do it.

Change your locks. It doesn't cost that much and will solve the issue of someone else having the keys to your place.

You can do it yourself; it's not that hard. And it's your legal right.

I'm not sure how it is in other states, but in Texas you cannot change the locks to an apartment yourself. However, you should be able to request that the management company does it.
 
It's illegal to change our own locks in PA too.

We did request the locks to be changed and I watched maintenance in my apartment doing something with the locks via a camera I set up to stream to my phone but then they called my girlfriend after and told her to come pick up new keys and we would be charged a fee. She went home first and low and behold our old key's still worked...

I honestly don't think this situation could get any crazier. We now have those things you use to wedge the doors shut. We are moving as soon a possible but at least now we don't have to sleep with weapons next to our bed.

Comcast received the warrant this weekend to find out who the account holder was that accessed the internet with the ipad. I hope to hear something soon, my arms are getting tired from shaking my fist...

First thing I did was change the locks on an apartment I was in back in college. They raised a poop fit, but I stuck t my guns. We have (had) a 'home domain' clause in an obscure law that allowed for us to do that, and ask that management notify us if they ever needed access to the apartment. Shortly after that, word got out that a disgruntled maintenance person was fired and took a master key and was 'leisurely' entering people's apartments and either stealing stuff, or moving stuff around in the apartments. The stupid management company didn't want to spring for new locks for all the apartments so they tried to ignore the problem. A neighbor realized what was going on (the maintenance man rifled through his ultra hot girlfriend's underwear) and that we had different door knobs. THEN they started changing the locks.

Stupid property managers... Yikes!

Less expensive would be a motion sensing video camera...
 
Got a call Thursday night, Comcast was finally ready to release the account info. He said it would take a day or two to get it then he had to turn around and get another warrant to search the account holders home. Should hear something today if not tomorrow, hopefully.

We are looking at a new place at the end of the week, def moving as soon as possible. I am growing tired of profiling every person who comes within 10 feet from my door.
 
I'm sorry this has happened to you, but this is why I have security cameras in my own apartment.

In college, I rented an apartment; one day I had this weird feeling someone was entering my apartment without my permission (or prior notice according to the contract).

Needless to say I installed a camera the same day and the next day while I was in classes, I found an agent (for the management company) entering my apartment, rifling through my things, and then leaving.

I didn't call the police at first, but I went to the management office asking why they were entering without permission. Of course they denied this, so I went to Home Depot, bought new locks and replaced them.

The next day they posted a notice on my door asking me why I changed my locks. With the notice and the video I called an attorney and they sent a notice to the management company.

For the next three years (until I moved out), they never bothered me anything from then onwards.

Sorry, this is a bit off topic, but I hope they find your iPad and catch the SOB.

In the meantime change your locks and get a security camera. I lived in PA if that matters to you.

If you know in Pittsburgh a verbal contract is valid for two years? (Just something I learned while I lived there)

I'd look into the possibility of going after your building super for fraud.
 
For the time being you should change the locks no matter what "the rules are". For emergency Access of Police Force or Firefighters the locks won't be that relevant. Change the locks back when you move out.

While it doesn't excuse the fact that they were going through your belongings, it is Pennsylvania state law that the management can enter an apartment without providing notice to the tenant. It's very landlord-friendly but isn't very comforting to the renter.

Nope. Not on that version of iOS. If you put a passcode lock they would have to do a DFU to get around that which means you won't ever find it. So hopefully they are too dumb to know that.

That it was taken out of a locked home was likely a factor in their response. For all we know this is part of a bigger case of similar breakins

Check those laws, that fee might be illegal also

There's only so much a single-core processor and 256MB RAM can do unfortunately, I still have a few friends with first gens but they're obsolete and are never used anymore, such a shame! 🙁
