Nope. 3rd party could still sell them because they had already been imported into the country. Apple themselves had to stop selling them immediately

It would've only been an option previously if they'd received stock before the import prohibition went into effect.

If it's being replaced under warranty or AppleCare+ then it will have a functional SpO2 sensor
