Are you using Boot Camp Assistant?
It shouldn't ask you to format your OSX side. At most it'll say a partition could not be created and you'll need to repair the disk.

well thats what it says.... but i dont want to do anything to my hdd so is there another solution?

Repairing the disk is not the same as reformatting...You attempt to repair the disk using the Mac-included Disk Utility application or something like Disk Warrior. It does a file structure check at the system level but does not clear any data. Never heard of anyone's computer breaking when attempting to repair disk, its either usually broken already or it is an issue that can be fixed by the repair process, so there is no harm or foul in trying that.

thanks for the help and i still want to back up my data just in case
