You mentioned paying the ETF of ~$100 as a possible option. I assume your plan was to use a dumb phone for 2-3 months instead? Couldn't you just use a dumb phone for the next few months and pay the data fee instead? Surely it'll be cheaper to pay $30 for 3 months than $110 now?

If she switches to a dumb phone for a few months, I don't believe that she has to pay the data fee. She could pick the cheapest plan available for that phone. Data is not required on those phones and I don't think that she will be tied to the data package.

Yeah, lying to Apple about warranty issues and getting your phone wet it one thing, the worst they'll do is refuse the repair. This is actually honest to goodness Insurance fraud, where they usually call the cops. Good luck with that.

Regardless of what phone you end up using, the ATT contract requires you to pay for $30 of data (since she signed up when unlimited was the only option) every month during the contract. Otherwise, everyone would buy an iPhone at the subsidized price, sell it for a profit on ebay/craigslist, and then cancel their data plan.

I had my iPhone stolen (well armed robbery) and ATT made one thing very clear: the data plan was locked in unless I paid the ETF. That was nonnegotiable.

No, it's called fraud. If she had renter's insurance prior to the accident, it would be fine, but you're encouraging her to lie on the form. That is a very severe felony in every state, and the $155 in savings is not worth the risk, however small, of a multi-year prison sentence.

I've been able to drop a data plan once I switch the imei over to a different phone before. The problem now is if you do that you would lose your unlimited plan.
 
wait can some1 clarify.. you can sell ure old iphone back yo apple? or just take back a damaged/defunct iphone - as long as there is no external damage

I actually asked this same question at the AT&T store last weekend. I was told from the associate that they will buy back the phone if you are using it to do an upgrade. In my case for my iphone 3GS, they were willing to give around $195 towards an upgrade. I assume this is to match Best Buy's buyback program.
 
My honest opinion; wait until June just to see whether the rumours flying over the internet are actually true.
