Not sure if this is already reported, or if it is indeed a bug and not by design now.

If I've downloaded something into my Downloads directory, when I drag it to the trash it vanishes from the Downloads directory, but the trash icon remains as empty. Yet when you click the trash icon, you can see everything in there.

The option to empty trash is disabled on the dock as it thinks its already empty, when its not.

I had this issue in Mountain Lion and Mavericks on the first boot up from installation. Open the trash can in finder, then create a new folder on the desktop. Drag that empty folder in to the trash can finder window. If this doesn't fix the icon in the dock then boot to recovery, repair disk and permissions. Then boot up in safe mode to allow the system to run through its clean up scripts. Then just reboot.
