I couldn't seem to find a definitive answer on MR, so I am still confused.

I have a iPhone 3G right now and am not eligible to upgrade until 2/2010. If I buy a 3GS off craigslist, will AT&T charge me more because I upgraded or will they automatically extend my contract because I upgraded. I do not think any of these two scenarios will happen but I want to confirm.

Agreed. I'd even hazard a guess that you would be able to use your existing SIM with your new 3GS.

Agreed. I don't see any reason why you'd even have to notify AT&T of the change. There is no plan difference between the 3G and 3GS.

Awesome. Thanks guys. Second question. Say I buy the 3GS off craigslist, my upgrade eligibility will not be affected, correct? Im able to upgrade 2/2010, so I should be fine for the next iphone June of 2010?

The only thing that would affect your upgrade status is to purchase a new device from at&t. So go ahead and get the 3GS from craigslist...

Isn't that the same question as before? If you buy a phone through a 3rd party (like craigslist), nothing will change with your account. You pull out your SIM card and put it in your new phone and besides that, nothing at all has changed.
 
No it won't change anything in your contract. Come next year you'll be able to get a new iphone, if it comes out. So go ahead and get it from CL. You'll save some money as opposed to ebay.
