if i jailbreak my phone, then restore... and need to take my phone to get swapped out... could apple tell?
 
No. Jailbreaking just lets you put files on it, essentially. It doesn't permanently change anything about the phone.
 
As long as you are with the official carrier for your country, you should be fine with the standard software.
