Nope . They checked and it didn't show in their system. When they did further researched they found out that it was bought from AT&T so no refund from apple.

Try taking it to an AT&T store and tell them you got it as a gift and would like to return it (for credit?) or perhaps exchange it. Or perhaps just sell it privately (if not just use it or give it to someone else you know that might need/want it).
