My iPhone 5a has a fault on it which i have discussed with Apple on the Internet and over the phone, they both agree it's a defect and to take it back, my phone is a week old now and I'm looking to take It back next week,

If they can repair it then I'm fine with that, but if they replace it, I wouldn't want a refurb? I'd want a brand new one , can I request a new phone from them?

Also do they give you the option to replace or do they just do it as I wouldn't want them walking off with my device and giving me a different one without me accepting

If its a week old, you can exchange for a new one. The rest - go talk to them and tell them what you want. You can then decide if their solution is acceptable.

Would this be brand new and sealed box? And
What's the oldest you would say before they will stop exchanging for brand new ones? I can get to my Apple store before its 2 weeks old I know that

Generally it would be whatever the return policy is basically.
 
Where did you purchase the phone from? You have to do return phone back to point of purchase to get a new in box. The Apple Genius Bar will only provide a service unit.

Return it and buy a new one. Problem solved.
 
In the UK you are legally entitled to a refund or new replacement if a product is less than 28 days old and develops a fault.

I got a family member to order it online directly from Apple which will be where I will take it back, would it be possible to just ask for a brand new sealed replacement instead of repairs or anything else? Would they let me do that?

Jords, simply ask them if they can replace with a new unit, however it's a 5S so you may get a refurb unit. So, your best bet if that happens is to just return the handset (as long as it's within two weeks) and re-purchase another 5S. Pretty sure they can do it without messing up all that contract stuff. One of my friends one year bought his 5S and it was having screen issues after a few days, so he took the phone into the store and they returned it and gave him a brand new boxed iPhone (with accessories). So yes, bring your box with you along with the earbuds and cord/charger as they may just take your entire handset and give you a new one.

Just to be safe probably a good idea to bring everything with you just in case.
