Basically

Two Cracks on top clam shell, and shadows lower left and right of the screen, the plastic behind the touch-pad is loose.

Also having a lot of weird noises from the super drive, when I put the OSX disk into the drive in the particular the drive makes a real grunting noise.

It does not really make huge noise but the clunking and noise is a bit strange for me.

I know I am due a replacement top shell, but given I am on finance and this MB is less then 4 months old, can I wangle them to offer me a replacement new shape basic MB?

The drive making a noise is entirely normal - Apple has been using these very noisy drives in their laptops for some time. Both my old MacBook and my new aluminium one sound like they are actually chomping up and cracking the disc when I insert one but it doesn't do any damage, it's just loud.
