i converted an hd mkv file with handbrake using the apple tv preset and using 4000 avg bitrate 720p

i know you have to maintain a certain framerate, my file has a framerate of 23.98 but the playing framerate seems to move between 23, 24, 25, and 27 fps.

will this still play on the apple tv (havent bought one yet, waiting till after sept 9) or should i let handbrake downconvert to 960 by 540

Well if you're using 4000 avg then you're not technically on the appleTV preset anymore. I'd recommend getting the latest snapshot build and updating your presets.

With the newer appleTV preset you may want to lower your quality setting a tad to around 58% or 59%. I had mine up around 61% and it caused some jittery playback on my appleTV. And yes, make sure your framerate is set at 24 fps if you're encoding at 720p otherwise it won't play.
