I was wondering if I could just copy & paste a recent backup thru Time Machine to another external hard drive?

I have a hard drive that's failing and I need to return it, so I must get the backup off of that drive and put it another hard drive I have. I guess I could just back up thru Time Machine onto this newer drive but I thought it would be faster just to copy & paste it.

NO.

It's not just the recent items that are backed up, TM has the history of all items, so...

Backup using TM onto new HDD.

If it's failing, also you may get a corrupted copy. Not recommended at all.

And don't forget to wipe thoroughly (7x at least using Disk Utility) the failing HDD before returning it.
