I want to use this Creative Commons trailer for a non-commercial work. Specifically I want to compose my own music for a demo reel.

1. Why does the description not mention CC even though it is CC. (I used YT's CC filter to find it)

2. I want to (a) strip all the audio and add my music or (b) rip the same scenes from a DVD so that I can retain the original dialogue without the music from the trailer so I can add my own music.

3. If your are using videos for non-commercial work aren't we protected in the first place? What if I want to use any BMW car commercial or movie trailer or food commercial for tutorial/demo reel purposes? It's non-commercial so what's the issue?
 

I used the filter to list CreativeCommons results and this video came up.

But the description doesn't mention CC.

Any ideas?

My first thought is there's a fault in YT's filter/tagging. I struggle to understand how big-budget studio movies can be CC.
Regarding non-commercial "protection" - I suggest you do more research on this, or have a lawyer standing by when the first bus load of studio lawyers show up.
